About Intellectual Property:
The Intellectual Property team at BioMarin consists of experienced IP professionals with solid educational backgrounds in science and patent law and extensive work experience in the biopharmaceutical industry. We are responsible for creating valuable IP assets consistent with business objectives and corporate directives. We focus on strategic activities including the establishment of IP portfolios to protect our products and product candidates, the implementation of offensive, defensive and competitive IP strategies, the creation of a cost-effective, efficient and comprehensive IP infrastructure and the provision of IP-related support cross-functionally to other company teams.
Location: Role requires onsite presence 2 days per week at HQ in San Rafael, CA
SUMMARY DESCRIPTION
This role will report to the GVP of Intellectual Property and supports all three patent counsel attorneys in the Intellectual Property Department.
Requirements
  • Scientific Background: Advanced degree in biological science (e.g., biochemistry, molecular biology, genetics, immunology, pharmacology) preferably PhD
  • Patent Bar Registration: Admission to practice before the United States Patent and Trademark Office
  • Work experience and technical skills:
  • 5 years’ experience (more than 2 years law firm plus more than 3 years in-house Biopharma, Research Environment) in patent prosecution and maintenance, IP diligence (search / analysis), oversight of patent portfolio development, publication review, IP-related support of biopharma drug development
  • Solid understanding of patent law, including prior art analysis, patentability assessments, and freedom-to-operate evaluations.
  • Experience with patent search tools and databases (PatBase, Clarivate, or Google Patents); Management software for documents (iManage) and patent docketing (Anaqua)
  • Familiarity with the drug development process and role of IP

Responsibilities
  • Identification of patentable subject matter through interaction with research, manufacturing, and clinical scientists; completion of invention disclosure forms
  • Diligence: word, chemical structure, sequence searches, evaluation of freedom to operate, patentability and competitive landscape
  • Patent Prosecution: preparation, filing and prosecution of patent applications
  • Assistance with preparation of legal opinions (validity, non-infringement)
  • Assistance with third party actions, including litigation and post grant proceedings
  • Establishment of cross-functional networks to provide IP-related support to other functional groups (Legal corporate, Business Development, Research, Manufacturing, Regulatory, Clinical, C etc.)
  • Participation in IP-related cross-functional meetings

The salary range for this position is: $144,000 to $198,000. BioMarin considers a variety of factors when determining base compensation, including experience, qualifications, and geographic location. These considerations mean actual compensation will vary. This position may also be eligible for a discretionary annual bonus, discretionary stock-based long-term incentives (eligibility may vary based on role), paid time off, and a benefits package. Benefits include company-sponsored medical, dental, vision, and life insurance plans.
